Right Cancelled by a Later Amendment
What does it mean?
A later notarized amendment repealed a right or section of the original Teilungserklärung outright, with no replacement. The original document may still describe that right as active, so reading the base declaration alone would be misleading.
Is this a problem when buying?
Something to clarify before buying. Not an automatic deal-breaker, but worth checking.
What you should do as a buyer
Confirm the repealed right is genuinely gone in the current rules, and check it isn't one you were counting on (e.g. a rooftop, parking, or cellar Sondernutzungsrecht tied to the unit you are buying).
